Bureaucrats have been ignoring due process and the rule of law for many years now, destroying our Constitution by pretending their “rules” are “civil”, not “criminal”, and therefore you are not entitled to due process or protections in the Bill of Rights. They can take your property in the War on Drugs without a conviction or even charging you with a crime. They call it “civil” asset forfeiture. It’s criminal theft by government without any due process. You have to sue to get your property back — if you can afford to sue.

ST. PAUL, Minn. (KMSP) - Hundreds of people turned out at federal court in St. Paul Tuesday morning to push for an overhaul of Minnesota child protection laws.

The group Stop Child Protection Services from Legally Kidnapping Children accuses the current law of treating parents like criminals and harming children more than it helps. The lawsuit asks for a jury trial to prove Minnesota child protection law is unconstitutional and over-reaching.

Amanda Weber brought her 10-month-old son Zayvion to the emergency room at Children's Hospital in St. Paul, Minnesota, in May because he'd been constantly coughing and previously had been treated for sleep apnea, Minnesota Public Radio reported.

Zayvion was hospitalized overnight, but Weber departed for Little Falls with her son the next morning prior to a doctor performing a follow-up examination, the outlet said. KMSP-TV reported that Weber wanted to go home after a long wait for another doctor and signed that she was leaving against medical advice.

A Minnesota mom whose 10-month-old son was taken from her by child protective services because she didn't stick around the hospital for a second opinion on his cough finally regained custody—four months and six court dates later. The judge ruled that the nurse who claimed Amanda Weber's actions left her child, Zayvion, in "danger of dying," had engaged in "disinformation."

It all started in May when Weber brought Zayvion to Children's Hospital for a cough. Doctors determined Zayvion was fine and stable, and after a long wait for another doctor, Weber wanted to go home and signed that she was leaving against medical advice. The next day, Zayvion was immediately taken away by CPS for medical neglect.

The child protection system in Minnesota is unjust and harmful to children, an advocacy group argued Tuesday, and as evidence, pointed to the decision by a state judge last week to return a 1-year-old boy to his mother.

"I am mad at the system for failing me and my son," said Amanda Weber, who brought her recently returned son, Zayvion, to a news conference in St. Paul.

The legal victory is symbolic for a coalition of parents and advocates seeking to change the state's child protection system. The group has argued that Minnesota's laws criminalize parents for what they consider to be routine parental discipline and have a disproportionate effect on black families.

Weber is relieved and happy to have her son home, and his sisters and grandparents are happy too, Weber said. She has three children and spent nearly four months without her youngest while he was in foster care.

LITTLE FALLS — Amanda Weber took her 10-month-old to the hospital in May for a persistent cough. She lost custody of him a couple days later.

She has joined an association of parents who claim Minnesota's child protection laws are unconstitutional and overly vague.

The group, called Stop Child Protection Services from Legally Kidnapping, sued the state in April and filed an amended complaint last week.

In Weber's case, a hearing Monday at the Morrison County Courthouse ended with a judge scheduling another hearing later this week. She hopes to regain custody of her youngest child then.

I am not personally a fan of spanking. In fact, I'm that annoying mom on Facebook posting Harvard Study articles on the effects of spanking on the neurological growth of children. I am 100% an advocate of personal growth, responsibility, and against ANY violence against children.

That being said, I do not believe that a parent spanking their child in a reasonable manner should be grounds for CPS taking children away from their families. Many feel they spank out of love, attempting to teach their children right from wrong through respecting and fearing authority.

In a letter filed in federal court Tuesday, the parents are seeking a court order declaring that certain state laws that govern when and how children can be removed from their homes are unconstitutional and deprive families of due process.
